These terms and conditions are intended for consumers who have full legal capacity. These terms and conditions apply to all orders you place on this website.
skinalix is not the manufacturer of the goods for sale. The characteristics presented (photos, descriptions, etc.) are based on information provided by the supplier. Nevertheless, skinalix adheres to current quality and manufacturing standards.
If the product and/or its characteristics do not correspond to the product received by the customer, we invite you to visit our refund policy on the skinalix website.
These general terms and conditions are presented in English.
Section 1 - The different steps to follow to conclude the online contract

You make your selection by browsing the pages of our website. Your selections are added to your shopping cart when you click "Add to Cart". At any time during your navigation on our website, you can confirm your order by clicking "Payment".
Contract Validation
When you click "Payment", a confirmation message appears. It summarizes all the products and options selected. On this page, you can either update your shopping cart by modifying quantities and/or deleting one or more items, or continue by checking the boxes: "I accept the Terms and Conditions" and "Secure Payment".
You must verify all the information provided on this order form, including all information relevant to delivery (delivery address, digital code, telephone numbers, etc.). Collecting the user's identification details (first name, last name, email address, bank details, etc.) in advance facilitates the contract conclusion process. Customers can therefore save their contact information by checking the "Save my details for next time" box.
If you do not need to modify the form and wish to proceed with your order, click "Continue to shipping method."

After payment has been made on our secure server (see "Payment"), an acknowledgment of receipt will be displayed. It confirms that your order has been registered and informs you that a confirmation email will be sent to you as soon as possible.

Legal Guarantees
In accordance with the legal provisions in force relating to the conformity of the goods to the contract, and regarding hidden defects (available in Appendix 1 of these terms and conditions), we will refund, repair, or exchange any product that appears defective, damaged, or does not correspond to your order.
We will also reimburse you for the full return shipping costs upon simple presentation of supporting documents (photos, videos, etc.).

Liability
We do our utmost to satisfy you. We are responsible for the proper execution of these general terms and conditions. However, we cannot be held liable for acts of God, force majeure, the unforeseeable and insurmountable actions of a third party to the contract, or for the product's non-compliance with foreign legislation in the event of delivery to a country other than France.
Section 4 - Delivery Times, Costs, and Terms

We will deliver the products to the address indicated on the order form.
Delivery Time
We will deliver the products no later than the date indicated in your order confirmation message. (17 to 21 business days maximum)
In the event of a delivery delay, we will notify you by email as soon as possible and offer you a new date.
If the ordered product is unavailable, we will notify you as soon as possible. We will offer you a product of equivalent quality or price.

Nevertheless, we remind you that we offer the “Order Notification” service, which gives you real-time notifications of the status and progress of your order (on average, 1 notification every 2 days).
Section 5 - Prices
The prices of our products are indicated in euros, all taxes included.
You must also check the possibilities of importing or using the products you order from us in the country of destination.
Section 6 - Payment methods and security measures
We do not collect your payment until your order has been dispatched. You are therefore free to cancel your order until it has been handed over to our carrier for shipment. As soon as your order has been handed over for shipment, you will receive an e-mail informing you that we are going to collect your payment.
However, it may sometimes happen that payment is collected when the contract is concluded.
Payment methods
You can pay for your skinalix.com purchases in several ways
- Bank cards: Visa, MasterCard, American Express, other credit cards.
Payment is made via the secure bank servers of our STRIPE partners. This means that no banking information concerning you is transmitted via our site.
Payment by credit card is therefore perfectly secure; your order will be recorded and validated as soon as payment has been accepted by the bank of your choice.

Payments via our website are subject to a secure system. We have adopted the SSL (Secure Socket Layer) protocol to encrypt credit card details. To protect you against possible intrusion, we do not store credit card numbers on our computer servers.
Section 7 - Money-Back Guarantee: Conditions for Exercising the Right of Withdrawal
In accordance with legal provisions, you may exercise your right of withdrawal within 14 days of receiving your product. You do not need to provide a reason or pay a penalty. With the exception of return shipping costs, which remain your responsibility, we will refund the full amount paid no later than 30 days following your withdrawal. You may also opt for another refund method upon our recommendation.
In accordance with legal provisions, the right of withdrawal cannot be exercised for products made to order, according to the consumer's specific specifications, or on audio, video, or computer software recordings unsealed by the customer.
Section 6 - Duration of the Contract and Price Validity
The products remain the sole property of skinalix until full payment has been received by PayPal or Stripe.
Our price offers are only valid within the limits of the validity period of the offer in question and available stock.
Our offers of goods and prices are valid if they appear online on the website on the day the order is placed.
Section 7 - Applicable Law/Competent Jurisdiction
These terms and conditions are subject to French law.
In the event of a dispute regarding substance or form, the French courts shall have exclusive jurisdiction.

Section 9 - Personal Information

Section 10 - Supplier & Owner Agreement
a. The Supplier and the Owner of the Online Store are each referred to as the "Party," or both are referred to as the "Parties";
b. The Supplier manufactures and supplies various products;
c. The Owner of the Online Store operates one or more websites that facilitate the search, purchase, and payment of various products from various suppliers;
d. The parties wish to establish a dropshipping cooperation, which is a retail delivery method in which the online store owner does not keep the goods in stock but instead directly transfers the end customer's orders and shipping details to the supplier, who then ships the goods directly to the end customer.
The online store owner will act, within the scope of its aforementioned activity, as an intermediary, facilitating the purchase and payment of the supplier's products by the end customers. The supplier will ship these products directly to the buyer. The online store owner will therefore not receive the products or import them; the online store owner will only inform the supplier of the purchase orders that have been placed.
f. In addition, the online store owner acts as the representative of the end customers and will therefore be their primary contact person: The online store owner will process payments on behalf of the end customers and will handle returns of purchased products on behalf of the end customers.
Appendix 1: Provisions of the French Consumer Code concerning the legal guarantee of conformity
Article L211-4
The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery.
The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the seller is responsible for this under the contract or when it was carried out under the seller's responsibility.
Article L211-5
To comply with the contract, the goods must:
1° Be fit for the use normally expected of similar goods and, where applicable:
- Correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- Present the qualities that a buyer can legitimately expect, given the public statements made by the seller, the manufacturer, or their representative, particularly in advertising or labeling;
2° Or present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, made known to the seller and accepted by the latter.
Article L211-6
The seller is not bound by public statements made by the manufacturer or its representative if it is established that the manufacturer was not aware of them and was not legitimately in a position to have been aware of them.
Article L211-7
Lack of conformity that appears within six months of delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise.
The seller may challenge this presumption if it is incompatible with the nature of the goods or the alleged lack of conformity.
Article L211-8
The buyer is entitled to demand that the goods conform to the contract. However, they may not contest conformity by invoking a defect that they knew about or could not have been unaware of when they entered into the contract. The same applies when the defect originates from the materials supplied by the buyer.
Article L211-9
In the event of a lack of conformity, the buyer shall choose between repair and replacement of the goods.
However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the extent of the defect. The seller is then required to proceed, unless impossible, according to the option not chosen by the buyer.
Article L211-10
If repair and replacement of the goods are impossible, the buyer may return the goods and receive a refund of the price or keep the goods and receive a partial refund.
The same option is available to the buyer:
1° If the solution requested, proposed, or agreed upon pursuant to Article L. 211-9 cannot be implemented within one month of the buyer's complaint;
2° Or if this solution cannot be implemented without significant inconvenience to the buyer, given the nature of the goods and the intended use.
However, the sale cannot be rescinded if the lack of conformity is minor.
Article L. 211-11
The application of the provisions of Articles L. 211-9 and L. 211-10 is free of charge for the buyer.
These same provisions do not preclude the award of damages.
Article L. 211-12
Actions resulting from a lack of conformity are time-barred after two years from delivery of the goods.
Article L211-13
The provisions of this section do not deprive the buyer of the right to bring an action resulting from latent defects as provided for in Articles 1641 to 1649 of the Civil Code, or any other contractual or extra-contractual action recognized by law.
Article L211-14
A recourse action may be brought by the final seller against successive sellers or intermediaries and the producer of the tangible personal property, in accordance with the principles of the Civil Code.
Appendix 2: Provisions of the Civil Code concerning the warranty against hidden defects
Article 1641
The seller is bound by the warranty against hidden defects in the item sold that render it unfit for its intended use, or that so diminish this use that the buyer would not have purchased it, or would have paid a lower price for it, had they been aware of them.
Article 1642
The seller is not liable for apparent defects of which the buyer could have convinced himself.
Article 1642-1
The seller of a building to be constructed may not be discharged, either before acceptance of the work or before the expiration of a period of one month after the buyer takes possession, from construction defects or lack of conformity that are apparent at the time.
There will be no grounds for termination of the contract or reduction of the price if the seller undertakes to repair the defects.
Article 1643
The buyer is liable for hidden defects, even if he was unaware of them, unless, in this case, he has stipulated that he will not be obligated to provide any warranty.
Article 1644
In the cases covered by Articles 1641 and 1643, the buyer has the option of returning the item and receiving a refund of the price, or keeping the item and receiving a partial refund, as determined by experts.
Article 1645
If the seller was aware of the defects in the item, he is liable to the buyer, in addition to returning the price received, for all damages.
Article 1646
If the seller was unaware of the defects in the item, he shall only be liable for the refund of the price and for reimbursing the buyer for the costs incurred in the sale.
Article 1646-1
The seller of a building to be constructed is bound, from the date of acceptance of the work, by the same obligations as architects, contractors, and other persons bound to the project owner by a work rental contract, pursuant to Articles 1792, 1792-1, 1792-2, and 1792-3 of this Code.
These guarantees benefit the successive owners of the building.
There shall be no grounds for rescission of the sale or reduction of the price if the seller undertakes to repair the damages defined in Articles 1792, 1792-1, and 1792-2 of this Code and to assume the guarantee provided for in Article 1792-3.
Article 1647
If the defective item perishes due to its poor quality, the loss is for the seller, who shall be liable to the buyer for restitution of the price and other compensation as explained in the two preceding articles.
However, loss arising from fortuitous events shall be for the buyer's account.
Article 1648
The action resulting from latent defects must be brought by the buyer within two years of discovery of the defect.
In the case provided for in Article 1642-1, the action must be brought, under penalty of foreclosure, within one year following the date on which the seller may be discharged from apparent defects or lack of conformity.
Article 1649
It does not apply to sales made by judicial authority.
